Please read these terms carefully. They explain what The Debt Company does — and importantly, what it does not do.

The most important thing to understand

The Debt Company is a referral and client-guidance service. We connect clients with qualified, independent specialists — we do not perform the legal, insolvency, or debt-related work ourselves. All formal legal work, court applications, asset administration, creditor negotiations, and insolvency procedures are carried out by independent attorneys, insolvency practitioners, and liquidators registered with the Master of the High Court. The Debt Company is not a law firm and does not provide legal services.

1. Who we are

The Debt Company ("we", "us", "our") operates this website and provides a consultation and client-guidance service. Our role is to assess a client's situation, provide general guidance, and connect the client with an appropriate independent specialist within our partner network.

2. The nature of our service

By using our website or services, you acknowledge and agree that:

  • We are a connection service. We link clients to independent qualified specialists. We do not ourselves carry out liquidations, sequestrations, rehabilitations, credit-bureau work, or any other formal legal or insolvency process.
  • The work is performed by independent professionals. The specialists we refer you to are independent practitioners responsible for their own professional work, advice, conduct, and outcomes.
  • We do not guarantee outcomes. No specific result can be promised. Every case is unique and outcomes depend on individual circumstances, the facts of the matter, and the applicable law at the time.
  • We are not your attorney. Using our service does not create an attorney-client relationship between you and The Debt Company. Any such relationship is formed directly between you and the independent specialist you engage.

3. Information on this website

All information on this website is provided for general informational purposes only. It does not constitute legal, financial, or professional advice, and must not be relied upon as such. Laws, regulations, fees, and procedures change — sometimes without notice — and the information here may become outdated. You should always contact us so we can assess your specific situation before acting on anything you read on this website.

4. Fees

Any fees quoted on this website are indicative and subject to confirmation based on the specifics of your matter. Fees for the formal legal work are a matter between you and the specialist engaged. We will always be transparent about costs during your consultation before any commitment is made.

To the maximum extent permitted by law, The Debt Company accepts no liability for any loss or damage arising from reliance on information on this website, from the services of any independent specialist we connect you with, or from any action taken or not taken on the basis of our general guidance. The independent specialists are responsible for their own work and advice.

6. Confidentiality, privacy & POPIA

We handle your personal information confidentially. Full details on how we collect, use, share, and protect your personal information are set out in our Privacy Policy, which forms part of these Terms.

By using this website or engaging our services, you acknowledge that you have read our Privacy Policy and consent — where consent is legally required — to the processing of your personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA) for the purposes set out in the Privacy Policy.

You retain all rights afforded to you under POPIA, including the right to access, correct, or request deletion of your personal information, and the right to lodge a complaint with the Information Regulator.
