The legal step that officially restores your financial rights, clears your credit bureau records, and gives you back the freedom to trade, borrow, and rebuild — after 4 years of insolvency.
If you were sequestrated (declared insolvent) at least 4 years ago, rehabilitation is the legal way to officially restore your financial rights. After a court grants your rehabilitation, your credit record is cleared, you can borrow money again, you can direct a company again, and you can trade in your own name. It's the closing chapter of the sequestration story.
Rehabilitation is the formal legal process under the Insolvency Act 24 of 1936 where a previously-sequestrated person applies to the High Court to restore their financial standing. Once granted, the rehabilitation order legally reverses the effects of sequestration: your financial rights come back in full.
While a person is under sequestration, South African law places significant restrictions on them — they cannot enter into contracts freely, they cannot be a company director, they cannot borrow money, and their credit record shows the sequestration. Rehabilitation is what removes all of those restrictions.
Most people apply at the 4-year mark — the earliest standard date. Waiting longer means living under insolvency restrictions unnecessarily. And under South African law, if you don't apply, you are only automatically rehabilitated after 10 years. Applying formally at 4 years is almost always the right call.
The rehabilitation order is used to update your records with all four SA credit bureaus (TransUnion, Experian, XDS, Compuscan). The sequestration entry is removed and your record is officially restored.
You can apply for credit again — home loans, vehicle finance, credit cards, business loans. Your fresh credit record will be built from scratch, but the sequestration restriction is gone.
Under sequestration, you cannot be a director of a South African company. After rehabilitation, you can register new companies, be appointed to boards, and run your own business again.
You can enter into contracts, buy and sell property, sign leases, and conduct business in your own name — without needing your trustee's consent.
Some professions (attorneys, chartered accountants, insurance brokers, financial services providers) have restrictions on unrehabilitated insolvents. Rehabilitation removes those restrictions.
The chapter closes. Officially, on paper, in court. You move forward without the shadow of an old insolvency following you around every credit application or new business venture. See the training company fresh-start scenario for the archetypal arc — company failure to personal sequestration, then rehabilitation, then a new business the owner now says is doing better than ever.
We confirm your date of sequestration, review your situation, and confirm you qualify to apply. You receive a transparent quote for the work.
Our partner attorneys prepare the rehabilitation application, the founding affidavit, and all supporting documents required by the High Court.
Creditors and the Master of the High Court are formally notified of the application, giving them the legal opportunity to object if they wish.
The application is heard in the High Court. In the vast majority of cases, there is no objection and the rehabilitation order is granted at the first hearing.
The court grants the rehabilitation order. This is the moment your financial rights are legally restored — under the law, you are no longer an insolvent.
The rehabilitation order is submitted to the credit bureaus (TransUnion, Experian, XDS, Compuscan). Your records are updated to reflect that you are now rehabilitated.
Typical timeline from engagement to court order: 3 to 6 months, depending on court roll times.
The most common path. You can apply for rehabilitation 4 years after the date the court sequestrated you. This is the earliest standard date and applies to the majority of our clients.
Under section 124 of the Insolvency Act, earlier rehabilitation is possible if: (a) creditors have been paid in full, or (b) a specific composition has been accepted, or (c) other statutory grounds apply. These cases are assessed on their facts.
If you don't apply, you are automatically rehabilitated 10 years after sequestration. This is the fallback — but it means living with sequestration restrictions for 6 years longer than necessary. Most people prefer to apply formally at the 4-year mark.
In the vast majority of rehabilitation applications, there is no objection. Creditors have already received whatever the estate could pay. By the 4-year mark, most creditors simply want to close the matter — objecting to rehabilitation gains them nothing.
No — you'll start with a clean slate but no positive credit history. You'll need to rebuild — a small credit facility used responsibly, a paid-on-time cellphone contract, an entry-level credit card. Most clients see a healthy score within 12 to 24 months of active rebuilding.
Yes — from the moment the rehabilitation order is granted. You can register a new company, be appointed to a board, or take up directorship of an existing one.
No. The debts that were dealt with in your sequestration were legally extinguished at that time. Rehabilitation restores your rights going forward — it does not resurrect the old debts.
Usually not. Your attorney appears on your behalf. If you've emigrated or moved provinces since your sequestration, we can still handle the application through the correct court.
